Introduction
An Adult Dependent Relative visa gives non-national applicants a chance to live in the UK with their close relative. It is intended for families wishing to reunite with elderly relatives who can no longer care for themselves adequately in their home country. This can be a pathway for settlement as well. Applicants need to adequately demonstrate dependency on the sponsoring relative, which could be physical, financial, or emotional in nature. The sponsor in this case must be settled in the UK or be a British or Irish citizen.
Who is eligible?
To be a sponsor, one must be a British or Irish Citizen or have a permanent resident status in the UK. Now, who qualifies as an ‘Adult Dependent Relative’? To be an ADR, you must be:
- a parent aged 18 years or over
- grandparent
- brother or sister aged 18 years or over
- son or daughter aged 18 years or over
of the sponsor and as a result of age, illness or disability, you require long-term personal care. You must also prove that you are unable, even with the financial help of your family member in the UK, to obtain the required level of care in the country where you are living because it is not available and there is no person in your country who can reasonably provide it, or because it is not affordable. Lastly, you must prove that you will be adequately maintained, accommodated and cared for in the UK by your family member, without recourse to public funds.
Meeting English language requirement
You do not need to prove your knowledge of the English language if you are applying as an adult coming to be cared for by a relative.
Meeting Financial Requirements
While the minimum threshold for maintenance, it is important to prove sufficiency of funds based on your particular circumstances. For instance, in case of a particular ailment, the sponsor must be able to sufficiently provide funds not only for your living expenses but also your medical expenses.
Providing evidence of illness, disability or age (Long-term personal care)
Evidencing long-term personal care is extremely crucial for this category. The applicant must, as a result of age, illness or disability, require long-term personal care to perform everyday tasks. This means they must be incapable of performing things like washing, dressing and cooking for themselves and require assistance with mobility. Extensive documents establishing this must be provided at the time of application. Additionally, financial and emotional dependency must also be established.
Processing times
For applicants applying from within the UK, decisions are generally made within 8 weeks. These timelines are, however, subject to individual circumstances. Applicants applying from outside the UK can expect a decision within 12 weeks.
