Introduction

The Parent of British Child visa is one of the UK’s Family visas, which allows non-nationals to join a family member in the UK. In this category, parents of children living in the UK can come to the UK to care for their child and settle in the UK, as long as they fulfil the eligibility requirements. It is a great visa pathway for families to unite and live together.

Who is eligible

In order to qualify for this route, the sponsor i.e. the child must either be settled in the UK or be a British or Irish citizen, or have a pre-settled status. Further, the sponsor must be under 18 on the date of the application and must have been under 18 when he/she was granted a long-term visa/citizenship. Another important requirement for the sponsor is that they must not lead an independent life, i.e. they must not be married or in a civil partnership.

In terms of the applicant, i.e. the parent must evidence that they either have sole or shared parental responsibility. Additionally, you must prove you are able to financially support yourself without claiming benefits or public funds and prove your knowledge of the English language. Lastly, you must also meet the basic suitability criteria as set out in the immigration rules.

Parental responsibility

This requirement states that the applicant must either have sole or shared responsibility of the child (sponsor). Shared responsibility means that the other parent of the child also has some contribution to the child’s upbringing and they are also settled in the UK. They must not be your partner. Additionally, you must prove that you play an active role in your child’s upbringing. It is important to seek adequate legal guidance and collate sufficient evidence to prove this requirement.

Meeting English language requirement

The applicant must prove that he/she has sufficient knowledge of the English language. This can either be done by furnishing your academic qualifications or by taking an English language test. You may also be exempt from the same in certain circumstances. It is important to assess what suits your case the best.

Meeting Financial Requirements

Naturally, you must prove that you have enough money to financially support yourself and your child while in the UK. Unlike some other types of Family visas, there is no formal minimum income requirement that you must meet in order to qualify for a Parent visa. You must also prove that you have access to adequate accommodation in the UK.

Processing times

The published processing times if you apply outside the UK comes to up to 12 weeks. It could take up to 12 months in case you are applying within the UK itself. However, you could opt for a priority service, where the decision is communicated to you within 30 working days for applications made outside the UK.

Extending your visa

The UK Parent visa is granted for a period of 2 years 9 months. Upon the expiry of this term you can extend your visa for another 2 years 6 months after which you may be eligible for settlement in the UK.

Eligibility for fee waiver

This category allows you to apply for a fee waiver in certain circumstances. The application for the same can be done online itself. These circumstances are:

  • You do not have a place to live and cannot afford one.
  • You have a place to live but cannot afford essential living costs like food or heating.
  • You have a very low income and paying the fee would harm your child’s wellbeing.

Switching to Parent of British child visa

You may be able to switch to this category only if you are in the UK on certain visa categories. In case of a switch application, you will only be able to stay for 2 years and 6 months.
