What is an ILR?

An ILR is a settlement route that allows you to permanently reside in the UK. It is also a pathway that brings you closer to British Citizenship. It gives you the right to live, work and study in the UK without any time period constraints. This pathway also allows you to bring your family members as dependants. It is an extremely revered and lucrative visa category and therefore, the requirements are quite complex. It is quite crucial to assess your circumstances and ensure that you meet all the requirements before proceeding with the application as the process is costly and can hamper your immigration background.

Who is eligible?

There are a lot of routes to qualify for an ILR and your current immigration status shall determine some of your eligibility requirements. You must show a lawful continuous residence of 2, 3, 5 or 10 years as per your current immigration status. The majority of ILR applications are through routes that require 5 years with lawful status and residence. You must have lived in the UK continuously for five years on a valid visa to be eligible for Indefinite Leave to Remain.

Further, you must also prove your knowledge of the English language, pass the Life in the UK test to be eligible for this visa category. Additional requirements may be applicable based on your immigration status. For instance, if you are currently on a UK Skilled worker visa, you would need to prove continuous residence of 5 years. Additionally you would also be required to meet the minimum salary threshold and prove that you are required at your current job role.

How much does it cost?

The general application fees for an ILR application is £2,885, per applicant. Additional fees will be applicable for premium processing services.

What is the duration?

The most striking feature of an ILR is that it allows you to remain in the UK ‘indefinitely’ i.e. without any time restraints. There is no duration for the validity period of this visa as it is granted for permanent residence in the UK. However, the holder may lose this status if they are away from the UK for a period of two years or more.

What documents are required?

Naturally, the documents required are subject to your particular circumstances. However, an ILR application would generally require the following documents –

  • Current and Previous Passport
  • Biometric Residence Permit
  • Proof of continuous residence (2, 3, 5, or 10 years, as applicable)
  • Proof of Knowledge of the English language
  • Life in the UK test certificate
  • Proof of meeting the minimum salary requirement (if applicable)
  • Proof of relationship (if applicable)

Can you apply for an ILR if the applicant’s partner is deceased?

Yes, you can. The ILR visa category does grant an exemption in case you are in the UK on a family/partner visa and your partner/sponsor dies. In such a case, you may still be eligible to apply for settlement.

Can you apply for an ILR if the applicant is a victim of domestic violence?

Yes, you can. If you are currently on a UK Spouse or any other Partner visa and your relationship has permanently broken down on the basis of domestic violence, you may still be independently eligible for settlement.
